2. Offer and conclusion of contract

(1) The products and prices shown on the website represent a non-binding offer.
(2) By submitting an order, the customer makes a binding offer to purchase the selected products.
(3) Confirmation of receipt of the order will be sent by email. The purchase contract is only concluded with an express order confirmation or the delivery of the goods.

3. Prices and payment terms

(1) All prices on the website are stated in euros and include VAT.
(2) Payment can be made using the payment methods offered on the website (e.g. PayPal, credit card, advance payment or cash on collection).
(3) The purchase price is due immediately after conclusion of the contract. In case of non-payment, Marmalad reserves the right to cancel the order.

4. Delivery and collection

(1) Delivery takes place within the delivery area specified in the ordering process.
(2) Orders can also be picked up on site at the bakery. The customer undertakes to collect the goods at the agreed time.
(3) Delivery times and costs are specified during the ordering process. Delays due to unforeseeable circumstances are possible.

5. Right of withdrawal and cancellation

(1) Since the foodstuffs in question are perishable, there is no right of withdrawal for individually manufactured goods (e.g. personalized cakes) according to Section 312g Paragraph 2 No. 2 of the German Civil Code (BGB).
(2) Orders can be cancelled up to 48 hours before the agreed delivery or collection date. After that, the full amount will be charged.

6. Warranty and Liability

(1) The customer is obliged to inspect the goods upon receipt. Complaints must be reported immediately.
(2) Marmalad is not liable for variations in taste or personal preferences.
(3) Liability for damages caused by improper storage or handling of the products by the customer is excluded.

7. Data Protection

(1) The customer data required for the order will be stored and processed in compliance with data protection laws.

8. Final provisions

(1) The law of the Federal Republic of Germany applies.
(2) Should individual provisions of these General Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
(3) The place of jurisdiction for all disputes shall be the registered office of Marmalad, provided that the customer is a merchant.
